§ 1 Scope of Application

These General Terms and Conditions (GTC) apply to all contracts between

(hereinafter Nexstorya) and its customers – both consumers within the meaning of § 13 BGB and entrepreneurs within the meaning of § 14 BGB (hereinafter each referred to as Customer).

Deviating or supplementary conditions of the customer shall not apply unless Nexstorya expressly agrees to their validity in writing.

§ 2 Description of Services

Nexstorya provides the following services:

• Visa consulting: Advice on entry and residence regulations, visa requirements and application procedures for various countries. The consulting is based on generally publicly available information. Nexstorya does not provide legal advice within the meaning of the Legal Services Act (RDG).
• International recruitment: Support in finding and placing specialists in an international context.
• Individual consultations: Bookable one-on-one sessions (online video call or telephone) on the above-mentioned topics.

The exact scope of services is set out in the respective service description on the website and the individual booking confirmation.

§ 3 Conclusion of Contract

The presentation of services on the website does not constitute a legally binding offer, but an invitation to submit an offer (invitatio ad offerendum).

The contract is concluded through the following steps:

1. The customer selects a service and completes the booking form on the website.
2. By submitting the form and completing the payment process, the customer makes a binding offer to conclude a consulting contract.
3. Nexstorya accepts the offer by sending a booking confirmation by email. The contract is concluded upon this confirmation.

Nexstorya reserves the right to reject booking requests without giving reasons. In case of rejection, any payment already made will be refunded immediately.

§ 4 Prices and Payment Terms

The applicable prices are listed on the Nexstorya website. All prices are final prices. Statutory VAT, where applicable, is included in the stated price.

Payment is made exclusively online via the payment service provider Stripe Payments Europe, Ltd. (1 Grand Canal Street Lower, Grand Canal Dock, Dublin, D02 H210, Ireland) by credit card or other offered payment methods. Payment data is processed exclusively by Stripe; Nexstorya has no access to complete payment data.

Payment is due upon completion of the booking process. The booked time slot is only bindingly reserved after full receipt of payment.

§ 5 Right of Withdrawal for Consumers

Consumers are generally entitled to a statutory right of withdrawal. Details are set out in the Right of Withdrawal Notice.

Note on early performance: If the consumer requests that Nexstorya begin providing the service before the end of the withdrawal period, and the consumer expressly consents to this, the right of withdrawal expires upon complete performance of the service pursuant to § 356 para. 4 BGB. The consumer confirms this consent via a corresponding checkbox in the booking process.

§ 6 Cancellation

Cancellation by the customer:

• Cancellation is only possible free of charge within the statutory right of withdrawal (for consumers).
• Outside the withdrawal period, a refund is excluded unless the appointment was cancelled by Nexstorya.

Cancellation by Nexstorya:

• Nexstorya is entitled to cancel a booked appointment for good cause (e.g. illness, technical failure). The customer will be informed immediately and will receive either an alternative appointment or a full refund of the amount paid.

§ 7 Service Delivery and Customer Obligations

Consultations take place online (video call or telephone). The location and access details are communicated in the booking confirmation.

The customer is obliged to be available at the agreed appointment time and to ensure the necessary technical requirements (stable internet connection, camera/microphone). If the customer does not attend the appointment, the service is deemed to have been provided; no refund will be made.

Nexstorya provides consulting services to the best of its knowledge and belief based on generally available information. No guarantee can be given for the outcome of visa applications or administrative procedures, as decisions rest exclusively with the competent authorities.

§ 8 Limitation of Liability

Nexstorya is liable without limitation for damages arising from injury to life, body or health, as well as for damages caused intentionally or through gross negligence.

Otherwise, Nexstorya's liability is limited to the foreseeable, contract-typical damage. This applies in particular to:

• Decisions by authorities and embassies on visa or residence applications
• Accuracy and completeness of official information over which Nexstorya has no influence
• Technical failures in the transmission of video calls, insofar as these are not caused by Nexstorya

Liability under the Product Liability Act remains unaffected.

§ 9 Data Protection

Information on the processing of personal data can be found in our Privacy Policy.

§ 10 Applicable Law and Place of Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

For consumers, this choice of law only applies insofar as the protection afforded by mandatory provisions of the law of the state in which the consumer has his habitual residence is not withdrawn.

For disputes with entrepreneurs, the exclusive place of jurisdiction is Passau. For consumers, the statutory place of jurisdiction applies.

§ 11 Final Provisions

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the statutory regulation.

Nexstorya reserves the right to amend these GTC at any time with effect for the future. For contracts already concluded, the GTC valid at the time of conclusion of the contract shall apply.
